By accessing Punkit Creative, testing live sandbox prototypes in Punkit Labs, submitting consultation audit requests, or licensing our autonomous production blueprints, you agree to be bound by these Master Terms of Service. If you are entering into this agreement on behalf of a company or legal entity, you represent that you possess the statutory authority to bind that entity.
Punkit Labs Blueprints: Pre-built automation templates, custom n8n node libraries, and dashboard source code in the Punkit Labs catalog are proprietary assets of Punkit Creative (Pty) Ltd. Licensed clients receive a perpetual, non-exclusive, non-transferable enterprise production license to deploy, execute, and integrate these solutions within their own corporate network.
Client Proprietary Data: All client databases, ERP configurations, historical ledger records, and custom business logic integrated into an automation remain the exclusive, sovereign property of the client.
Punkit autonomous solutions operate under strict Human-in-the-Loop (HITL) governance protocols:
AP invoice extraction, debtor settlement discounts, and bank payments require executive sign-off or two-factor approval prior to final ledger balance modification.
POPIA breach notifications, SETA WSP submissions, and BCEA leave balance adjustments generated by our AI models must be reviewed by qualified corporate officers.
AI CV screening scores provide recommendation matrices; final hiring, interview shortlisting, and employment equity determinations remain human decisions.
While models (GPT-4o, Groq LLaMA 3.3) achieve 99%+ accuracy on structured OCR and JSON extraction, automated outputs should not replace professional legal or accounting counsel.
For enterprise retainer and managed automation clients:
To the maximum extent permitted by South African law, Punkit Creative (Pty) Ltd shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from third-party API outages (e.g. Xero, Sage, WhatsApp Cloud, OpenAI API downtime) or unverified automated financial executions.
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any formal dispute arising out of or in connection with this agreement shall be submitted to the jurisdiction of the High Court of South Africa or resolved through expedited commercial arbitration in Johannesburg / Cape Town.
